Car accident claims

Process after a car accident

    1. According to California law, if the following situations occur, the police will report to the police within 24 hours, and the police will issue an accident report to determine responsibility

    2. Collect evidence at the scene of the accident (photo of the vehicle, the driver of the other party, the identity of the vehicle owner and insurance information)

    3. Hire professional lawyers to handle claims

    4. According to California law, if the following situations occur, fill in the HYPERLINK "https://dmv.ca.gov/portal/uploads/2020/05/sr1.pdf" SR-1 form within 10 days and report it to DMV I.  Someone is injured II.  Someone dies III. Property damage exceeds $1,000

    5. If you are injured, please go to the hospital in time and keep medical records and receipts

    6. Contact the insurance company to settle the claim. No matter who is at fault, you must first contact your insurance company. If the other party is at fault, contact the other party's insurance company, and the other party's insurance claim adjuster will determine the damage to the vehicle and then compensate. In the event of personal injury, whether the insurance company will compensate depends on whether the insurance purchased by the accident party covers it. Application materials

The client needs to submit a list of information:

    1. Describe how the car accident happened;

    2. The date, time and location of the accident;

    3. Driver’s name, contact information, address, date of birth, driver’s license number, and driver’s license state;

    4. Vehicle information (brand, license plate number, vehicle identification code and state of license plate);

    5. The insurance company and its NAIC number, insurance policy number and insurance start and end dates, and the name of the applicant (information about the vehicle and insurance can be found on the insurance policy, and the client can provide a copy of the insurance policy to the law firm);

    6. The name, contact information, address, driver's license number and state of the driver's license of the other driver;

    7. The other party's vehicle information (brand, license plate number, vehicle identification code and state of license plate);

    8. The insurance company of the other party's vehicle and its NAIC number, insurance policy number and insurance start and end dates, and the name of the insured (the client should take pictures of the other's driver’s insurance policy in time to save relevant information in the event of a car accident);

    9. If a person is injured or killed in a car accident, the person’s name and address must be provided

 

Note that it is possible that the driver and the owner are not the same person. Therefore, the name, contact information, address, and date of birth of both parties are also required.
